MIAMI - A Florida appellate court has remanded a dispute over reinsurance coverage for casualties resulting from an airplane crash, ruling that the trial court should consider extrinsic evidence in interpreting the reinsurance policy's ambiguous language. Kiln PLC, et al. v. Advantage General Insurance Company Ltd., No. 4D10-2995 (Fla. App., 4th Dist.).
On Feb. 22, the Florida District Court of Appeal, 4th District, further ruled that an issue of fact exists as to the role of a broker and whether his understanding of the policy may be imputed to the cedent.
