CHARLOTTE, N.C. - Arrowood Indemnity Co. has asked a North Carolina federal judge to appoint an umpire to oversee its reinsurance arbitration with Harper Insurance Co., asserting that the parties have arrived at an impasse in the selection process. Arrowood Indemnity Co. v. Harper Insurance Co., No. 3:12-3 (W.D. N.C.)
In a Jan. 4 petition, Arrowood argues that the court is authorized to appoint an umpire under the Federal Arbitration Act and the Convention on the Recognition and Enforcement of Foreign Arbitral Awards because Harper's refusal to select an umpire has caused a lapse or deadlock.
