Judge Refuses to Enforce Agreed-Upon Umpire Selection Process

TRENTON, N.J. -- A federal judge has opted not to intervene in an umpire selection dispute in an asbestos-related reinsurance arbitration, noting that the petitioner has already obtained the relief sought in previous filings. Everest Reinsurance Co. v. Century Indemnity Co., No. 11-2789 (D. N.J.).
On Oct. 31, Judge Mary L. Cooper of the U.S. District Court for the District of New Jersey found that granting Everest Reinsurance Co. relief beyond that requested in the original petition would be inappropriate and prejudicial to Century Indemnity Co.
