Judge Allows Arbitration to Continue, Finds Arbitrators Qualified

NEW YORK - A federal judge has refused to issue a preliminary injunction staying an arbitration, ruling that the arbitrators are "professional business persons knowledgeable of the aircraft industry" as required by the agreement's arbitration clause. B/E Aerospace Inc. v. Jet Aviation St. Louis Inc., No. 11-4032 (S.D. N.Y.).

On July 1, Judge Barbara S. Jones of the U.S. District Court for the Southern District of New York further ruled that the court was authorized under the Federal Arbitration Act to review the arbitrators' qualifications before an award has been issued.
