Liberty Mutual Asks Court to Appoint Umpire to Oversee CNA Arbitration

BOSTON - Liberty Mutual Insurance Co. has asked a federal court to appoint an umpire to oversee its reinsurance dispute with Continental Insurance Co., asserting that the parties have reached a stalemate in the umpire selection process. Liberty Mutual Insurance Co., et al. v. Continental Insurance Co., No. 11-11245 (D. Mass.).
In the July 14 complaint filed in the U.S. District Court for the District of Massachusetts, Liberty Mutual asserted that CNA failed to comply with the umpire selection procedure and presented a slate of proposed candidates "that are neither neutral nor diverse."
