Lexington Not Liable for $28.2 Million Claim, Judge Rules

BOSTON - Lexington Insurance Co. is not required to pay a $28.2 million reinsurance claim submitted by United Health Group Inc. because the reinsurer was prejudiced by untimely notice, a federal judge has ruled. Lexington Insurance Co. v. United Health Group Inc., No. 09-10504 (D. Mass.).
On Feb. 15, Judge Nancy Gertner of the U.S. District Court for the District of Massachusetts granted Lexington's motion for summary judgment, ruling that loss run reports submitted by United did not constitute adequate notice of the claim.
