TRENTON, N.J. - Everest National Insurance Co. is not required to produce documents that were previously designated confidential in a reinsurance contract dispute to the parties in a pending Colorado federal bankruptcy proceeding, a New Jersey federal magistrate judge has ruled. Everest National Insurance Co. v. Sutton, No. 07-722 (D. N.J.).
On Oct. 28, Magistrate Judge Tonianne J. Bongiovanni of the U.S. District Court for the District of New Jersey ruled that good cause exists for maintaining the previous confidentiality order in its entirety because the documents at issue contain confidential business information.
