CCC Seeks Summary Judgment in $17 Million Dispute

KANSAS CITY, Mo. - AXA Global Risks (UK) Ltd. has failed to show it that it was prejudiced by Continental Casualty Co.'s alleged late notice of an underlying coverage claim and therefore may refuse to pay its share of a $17 million reinsurance billing to CCC, the insurer contends. Continental Casualty Co. v. AXA Global Risks (UK) Ltd., et al., No. 09-00335 (W.D. Mo.).

In its Sept. 2 motion for partial summary judgment, CCC argues that under Missouri law, reinsurers must show that they were prejudiced by a cedent's breach of a claims cooperation clause before denying payment.
