KANSAS CITY, Mo. - A Missouri federal judge has refused to certify for appeal an order that the statute of limitations bars six of the eight claims brought by a reinsurer against Massachusetts Mutual Life Insurance Co. Employers Reinsurance Corp. v. Massachusetts Mutual Life Insurance Co., No. 06-0188 (W.D. Mo.).

Chief Judge Fernando J. Gaitan Jr. of the U.S. District Court for the Western District of Missouri ruled that the issue is not a "controlling question of law" because the order dealt with the meaning of the reinsurance treaty based solely on the language of the treaty.
