$3.4 Million Suit Against Clearwater Sent to Mediation

NEW YORK - A New York federal judge has approved for mediation a suit brought by Granite State Insurance Co. against Clearwater Insurance Co. seeking $3.4 million in reinsurance coverage for underlying asbestos claims. Granite State Insurance Co. v. Clearwater Insurance Co., No. 09-10607 (S.D. N.Y.).

In a June 16, Judge Richard J. Holwell of the U.S. District Court for the Southern District of New York explained that the mediation process will be confidential and will be "treated as a compromise negotiation for purposes of the Federal Rules of Evidence and state rules of evidence.'
