Reinsurers Urge Judge to Dismiss $6 Million Action

KANSAS CITY, Mo. - Two reinsurers are urging a Missouri federal judge to dismiss a suit seeking reinsurance proceeds, arguing that the cedent, CCC Casualty Co., breached the contract's claims co-operation clause by failing to provide timely notice of the underlying loss. CCC Casualty Co. v. AXA Global Risks (UK) Ltd., et al., No. 09-00335 (W.D. Mo.).
In a June 11 brief, AXA Global Risks (UK) Limited and Assicurazioni Generali UK S.p.A. further assert that CCC did not cooperate with the reinsurers "in any fashion in the adjustment and settlement of the loss."
