Ecuadorian Company Asks Judge to Toss Folksamerica Suit

MIAMI - An Ecuadorian construction company seeks dismissal of a lawsuit brought by Folksamerica Reinsurance Co., asserting that it was not served in accordance with the Inter-American Convention on Letters Rogatory. Folksamerica Reinsurance Co. v. Constructora Del Litoral S.A., et al., No. 10-20560 (S.D. Fla.).
Folksamerica sued Constructora Del Litoral S.A. and its president for $51,783 allegedly owed under a bond reinsurance contract. The suit, originally filed in the Miami-Dade County Circuit Court, was removed by COLISA to the U.S. District Court for the Southern District of Florida.
