Judge Confirms $6.6 Million Award, Denies Setoff Request

CHICAGO - An Illinois federal judge has confirmed a $6.6 million arbitration award rendered in favor of Trustmark Insurance Co. and denied Clarendon National Insurance Co.'s request for a ruling that the award was satisfied by setoff. Trustmark Insurance Co. v. Clarendon National Insurance Co., No. 09-1673 (N.D. Ill.).

On Nov. 20, Judge David H. Coar of the U.S. District Court for the Northern District of Illinois ruled that he does not have discretion to rule on the issue of setoff because "does not bear on challenges to the Panel's conduct or the substance of the Award itself."
