Judge Allows TIG to Proceed Against Aon in California State Court

DALLAS - A Texas federal judge has thwarted a reinsurance broker's efforts to prevent TIG Insurance Co. from proceeding with a California lawsuit arising out of a 1998 reinsurance transaction, ruling that a previous Texas federal court ruling does not have a preclusive effect on the claims. Aon Re v. TIG Insurance Co., No. 09-0300 (N.D. Texas).
In a Sept. 28 decision, Judge Jane J. Boyle found it unclear as to whether the previous rulings on the claims of negligence, negligent misrepresentation, and breach of fiduciary duty constituted judgments on the merits entitled to claim-preclusive effect.
