CAMDEN, N.J. - In response to a motion to reconsider filed by Certain Underwriters at Lloyds, a New Jersey federal judge has certified to an arbitration panel certain questions regarding the enforceability of a final arbitration award. Certain Interested Underwriters at Lloyds v. Pinehurst Accident Reinsurance Group, et al., No. 08-02950 (D. N.J.).
In a June 4 order, U.S. District Judge Renee M. Bumb of the U.S. District Court for the District of New Jersey certified to the panel questions concerning the mandatory nature of the treaties' commutation language and the formula by which the damages should be calculated.
