Judge Refuses to Stay Commutation Dispute Between CNA, SCOR

CHICAGO - An Illinois federal judge has refused to stay pending arbitration a $1.7 million dispute over whether a commutation agreement between SCOR Group and two CNA companies includes certain reinsurance contracts issued by Allstate Insurance Co. and Unity Fire and General Insurance Co. Continental Casualty Co., et al. v. Commercial Risk Re-Insurance Co., No. 1:07-cv-06912 (N.D. Ill.).

In an April 16 order, Judge Harry D. Leinenweber in the U.S. District Court for the Northern District of Illinois ruled that the dispute is not arbitrable because the commutation agreement does not include an arbitration provision.
