ST. LOUIS - Material issues of fact surround the question of whether the parties to 43 facultative reinsurance contracts intended to arbitrate disputes arising from these contracts, a Missouri federal judge has ruled in a $48 million reinsurance case. Midwest Employers Casualty Co. v. Legion Insurance Co., No. 4:07-870 (E.D. Mo.).

In a March 24 order, Judge Catherine D. Perry of the U.S. District Court for the Eastern District of Missouri denied a motion for summary judgment filed by Midwest Employers Casualty Co.
