DETROIT - The Michigan Catastrophic Claims Association has asked a Michigan federal judge to compel Old Republic Insurance Co. to produce documents withheld on the basis of attorney-client privilege. Old Republic Insurance Co. v. Michigan Catastrophic Claims Association, No. 2:08-cv-12533 (E.D. Mich.).

In a March 23 motion filed in the U.S. District Court for the Eastern District of Michigan, MCCA asserts that Old Republic may not invoke the attorney-client privilege as a basis for its refusal to produce 955 items because the communications at issue included third parties and were, therefore, not confidential.
