Judge Grants Unopposed Motion to Remand in Louisiana Case

NEW ORLEANS -- A federal judge has remanded a benzene case to state court after finding that a plaintiff's motion to remand was unopposed and meritorious. Tessitore v. Chevron Ornite Co., et al., No. 06-4126 (E.D. La.).

In a one-page order issued Oct. 3, the U.S. District Court for the Eastern District of Louisiana granted the plaintiff's motion, remanding the claims to the Louisiana Civil District Court for the Parish of Orleans.

Dean Charles Tessitore claims that his pressure washing duties at Gulf South Hydro Blasting for three years exposed him to benzene, causing him to develop non-Hodgkin's lymphoma. …
