Benzene Plaintiff Takes Causation Dispute to 5th Circuit Court of Appeals

NEW ORLEANS -- Prompted by a Louisiana federal court's refusal to reconsider dismissing a benzene complaint on causation grounds, the plaintiff has filed a notice of appeal to the U.S. Court of Appeals for the 5th Circuit. Seaman v. Seacor Marine LLC, No. 08-30911 (5th Cir.).

According to the 5th Circuit's online docket, a briefing notice was issued on Oct. 2, requesting the plaintiff's opening brief by Nov. 12.

The plaintiff filed a notice of appeal on Aug. 28, shortly after the U.S. District Court for the Eastern District of Louisiana denied Larry Seaman's request to reconsider the dismissal …
