Del. Supreme Court Upholds $3.4 Million Benzene Verdict

WILMINGTON, Del. -- The Delaware Supreme Court has released a one-page order affirming a $3.4 million verdict entered in favor of a plaintiff who said her husband's acute myelogenous leukemia was caused by exposure to benzene. Texaco Inc. v. Connie L. Gates, et al., No. 192, 2008 (Del. Sup. Ct.).

In the Oct. 23 order, the court cited, as grounds for affirming, the reasoning applied by a lower court when it found that some of the defendant's challenges to causation would fail even if they were not procedurally barred.
