Appeals Court Directs Trial Court to Quash Requests for Production

BEAUMONT, Texas -- A Texas appellate court has directed a trial court to enter an order quashing requests for production served on two benzene defendants, finding that the lower court should have limited the breadth of the requested discovery. In re: Mallinckrodt Inc., et al., No. 09-08-227 CV (Texas Ct. App., 9th Dist.).

In the August 14 opinion, the Ninth District Court of Appeals found that the trial court could have tailored the discovery requests to include product identification and the time periods in question.
