Defendant Moves for Summary Judgment, Says Plaintiff Has BAL

LOS ANGELES -- A defendant in California has filed a motion for summary judgment on causation grounds, saying that the plaintiff cannot use data involving acute myelogenous leukemia because the plaintiff instead has another type of leukemia of "ambiguous lineage." Park, et al. v. Akzo Nobel Coatings Inc., et al., No. BC350703 (Calif. Super. Ct., Los Angeles. Cty.).

A hearing on the motion is scheduled for Sept. 19 in the Los Angeles County Superior Court.
