Plaintiff Challenges Motion to Strike, Says Defendant Fails to Show Prejudice

WINSTON-SALEM, N.C. -- A benzene plaintiff is opposing a motion to strike portions of her expert reports, saying that ExxonMobil Chemical has failed to show that it was prejudiced or harmed by supplements to the reports. Stromberg, et al. v. Ashland Inc., et al., No. 07-332 (M.D. N.C.).

In a July 14 reply brief filed in the U.S. District Court for the Middle District of North Carolina, however, the defendant claims that the plaintiff still has yet to prove that her deceased husband was exposed to benzene in ExxonMobil products during his employment.
