WINSTON-SALEM, N.C. -- A benzene defendant has backed its motion to dismiss based on a violation of the statute of limitations, refuting the plaintiff's contention that the claims are proper because they are connected to a recently-developed disease. Stromberg, et al. v. Ashland Inc., et al., No. 07-332 (M.D. N.C.).

On June 20, ExxonMobil claimed in the U.S. District Court for the Middle District of North Carolina filing that the decedent's acute myelogenous leukemia was a "complication or aggravation of his initial disease, myelofibrosis."
