High Court Affirms Reversal of $2 Million Benzene Verdict

JACKSON, Miss. -- The Mississippi Supreme Court has upheld the reversal of a $2 million benzene verdict in a 5-3 decision released by the court on June 12, HarrisMartin is reporting. Watts v. Radiator Specialty Co., et al., No. 2006-CA-01128-SCT (Miss. Sup. Ct.).
Saying that while there was no question that plaintiff expert Barry Levy, M.D., was qualified to offer his opinion during the benzene trial, the state's high court found that none of the studies Dr. Levy relied on "provide a basis for the conclusion that there is a causal connection between benzene exposure and non-Hodgkin's lymphoma...."
