North Carolina Benzene Plaintiff Defends Complaint as Timely

WINSTON-SALEM, N.C. -- A benzene plaintiff argues that because her amended complaint asserts new claims based on a recently-developed disease, it is timely filed under North Carolina law. Stromberg, et al. v. Ashland Inc., et al., No. 07-332 (M.D. N.C.).

In her opposition brief filed in May in the U.S. District Court for the Middle District of North Carolina, the plaintiff says that although she is now asserting two separate injuries stemming from benzene exposure, this does not defeat her wrongful death claim.
