Defendants Agree to Pay up to $19.8 Million under Terms of Settlement

GOSHEN, Ind. -- Parties involved in a class action lawsuit containing allegations of groundwater benzene contamination have reached a settlement, according to court documents filed recently in the Indiana Superior Court for Elkhart County. Bowens, et al. v. 7-Eleven, Inc., et al., No. 20D03-0209-CT-48 (Ind. Super. Ct., Elkhart Cty.).

The court will oversee a final approval hearing on Feb. 29, sources told HarrisMartin.

According to a Nov. 1 settlement agreement filed in the court, defendants 7-Eleven, MDK, C&J Realty, L.P. and ENSR have agreed to pay up to $19.8 million for costs relating to site investigation and remediation expenditures.
