Wash. State Defendants Seek Dismissal for Failure to Identify Products

SEATTLE -- Several benzene defendants named in a Washington state case have sought dismissal of the claims, citing the alleged failure of the plaintiff to complete product identification. Smith, et al. v. 3M Company, et al., No. 06-2-10994-5 KNT (Wash. Super. Ct., King Cty.).
On Aug. 31, Fisher Scientific filed a motion for summary judgment in the Washington Superior Court for King County, saying that the presence of a Material Safety Data Sheet at the site of plaintiff's alleged exposure does not necessarily guarantee that the plaintiff worked with the defendant's product.
