WINSTON-SALEM, N.C. -- Plaintiffs in a North Carolina benzene complaint have opposed two separate motions to compel, saying that the information sought relating to a prior litigation is not discoverable. Stromberg, et al. v. Ashland Inc., et al., No. 07-332 (M.D. N.C.).
In the first opposition, filed Sept. 7 in the U.S. District Court for the Middle District of North Carolina, the plaintiffs contend that because a former employer is not named in the lawsuit, was not served with a copy of the answer and was not given a right to appear and answer allegations, the defendant cannot ask questions …
