NEW YORK -- A magistrate judge has recommended that summary judgment be awarded to Ashland, opining that there is no evidence tying the defendant's benzene to the chemical plant where the plaintiff alleges exposure occurred. Nelson, et al. v. Ashland Inc., et al., No. 05-10364 (S.D. N.Y.).
In the Aug. 7 report and recommendation issued in the U.S. District Court for the Southern District of New York, Chief U.S. Magistrate Judge Lisa Margaret Smith recommended that Judge Charles L. Brieant deny as moot cross-motions filed by the plaintiff questioning the admissibility of experts proffered by Ashland.
