Judge Enters Modified Scheduling Order, Warns Against Future Changes

CHARLESTON, W.Va. -- A West Virginia judge had granted a joint motion to amend a scheduling order, but warned the parties that since the case had been pending since 2005, no future extensions would be awarded. Brewer, et al. v. Monsanto Co., et al., No. 05-01183 (S.D. W.Va.).

In a July 3 order, Judge Mary E. Stanley of the U.S. District Court for the Southern District of West Virginia said, however, that "the docket sheet reflects little discovery activity in this action during the past four months [and] requests for further extensions will not be granted, absent extraordinary circumstances."
