WILMINGTON, Del. -- Counsel involved in the Delaware benzene litigation have proposed a general causation hearing to determine admissibility standards in cases where the defendants claim the plaintiffs were only exposed to trace amounts of benzene. In re: Benzene Litigation, No. 06C-BEN-1 (Del. Super. Ct., New Castle Cty.).
The June 21 status report filed in the Delaware Superior Court for New Castle County proposes that the parties depose life-style witnesses and treating physicians and then hold a Daubert hearing on the issue of general causation.
