LOS ANGELES -- The Los Angeles Superior Court has filed an order explaining its decision to grant 12 defense motions for summary judgment in which it rejected specific expert testimony and both specific and general causation proffered by the plaintiffs. Moss, et al. v. Venoco, et al., No. BC297083 (Calif. Super. Ct., Los Angeles Cty.).
The Dec. 12 order specifically rejected many of the plaintiffs' theories that while benzene exposure may not be directly linked to the specific disease alleged, exposure to the carcinogen weakened their immune system and promoted the disease.
