Hearing Set in PepsiCo's Challenge to Specificity in Soda Lawsuit

LOS ANGELES -- A hearing on PepsiCo's renewed motion to dismiss an amended benzene soda lawsuit is scheduled for March 2, according to the federal court docket. Jolly, et al. v. PepsiCo, et al., No. 06-0802 (S.D. Calif.).

On Nov. 6, the U.S. District Court for the Southern District of California also stipulated that opposition papers should be filed by Feb. 16 and that a subsequent reply brief should be filed by Feb. 23. PepsiCo claims in the motion to dismiss that the plaintiffs still fail to identify false or misleading advertising associated with the company's Diet Pepsi Twist product.
