BUFFALO, N.Y. -- Defendants in a New York benzene action are appealing the denial of an in limine motion in which the defendants claimed that plaintiff experts have failed to quantify the level of benzene exposure or cite literature associating a dosage with the alleged injury. Nawrocki v. The Coastal Corp., et al., No. I 2001/11247 (N.Y. Sup. Ct., Erie Cty.).
Sources told HarrisMartin that the defendants have filed a notice of appeal contesting a June 14 New York Supreme Court of Erie County decision that denied a motion to exclude medical causation testimony.
