ST. LOUIS, Mo. -- On June 5, Union Pacific objected to an affidavit submitted in a benzene action, saying that the declarations contained in the document were not based on personal knowledge and contained inadmissible hearsay. Lewis, et al. v. Radiator Specialty Co., et al., No. 06-00759 (E.D. Mo.).

The motion to strike the affidavit of Dan Francis, former counsel of the plaintiffs, was filed in the U.S. District Court for the Eastern District of Missouri and claimed that the affidavit was not served on Union Pacific, as the plaintiff asserted.
