KNOXVILLE, Tenn. -- A Tennessee couple has re-filed their benzene lawsuit almost one year after they voluntarily dismissed the claims. McCarter, et al. v. Alcoa, et al., No. 06-00141 (E.D. Tenn.).
Robert and Sharon McCarter filed their complaint April 13 in the U.S. District Court for the Eastern District of Tennessee, alleging that Robert's work repairing forklifts exposed him to benzene-containing products. The McCarters claim that Robert developed aplastic anemia as a result of the work exposure.
On May 18, 2005, a Eastern District of Tennessee judge granted an unopposed motion by the McCarters to dismiss their claims without prejudice. …
