PHILADELPHIA - Radiator Specialty Co. said a Pennsylvania couple's benzene claims are preempted by the Federal Hazardous Substances Act. Farley, et al. v. Radiator Specialty Co., et al. No. 2:05-cv-5059 (E.D. Pa.).
Hershel and Martha Farley allege that Hershel's employment as a factory worker and wood-crafter exposed him to the benzene containing products Liquid Wrench and Klean Strip, which the couple says caused his acute myelogeneous leukemia.
Radiator Specialty removed the lawsuit to the U.S. District Court for the Eastern District of Pennsylvania on Sept. 22, contending that its products are regulated by the Consumer Product Safety Commission and …
