BEAUMONT, Texas - ConocoPhillips Co. said a Texas couple fails to state a claim against them in their lawsuit against the company for an alleged injury caused by benzene exposure. Koger, et al. v. Ashburn Industries Inc., et al. No. 1:05-cv-839 (E.D. Texas).
In their Jan. 11 motion to dismiss, ConocoPhillips said Larry and Kim Koger failed to state a claim against the company because they do not allege any act or omission on the part of ConocoPhillips.
