EL DORADO, Ark. -- Radiator Specialty has opposed a motion to remand, contending that its benzene-containing product was regulated by federal law and additionally that the plaintiff failed to timely file the motion. West, et al. v. Aervoe Industries, et al., No. 05-01099 (W.D. Ark.).

In its Dec. 13 opposition to remand filed in the U.S. District Court for the Western District of Arkansas, Radiator Specialty asserts that its Liquid Wrench product has been identified as hazardous by the Consumer Product Safety Commission and is therefore regulated by the Federal Hazardous Substances Act.
