EL DORARDO, Ark. -- Plaintiffs in a benzene lawsuit have opposed a motion to dismiss, stating that their complaint sufficiently names specific chemicals, products and the illnesses that arose as a result of exposure to benzene. West, et al. v. Aervoe Industries, et al., No. 05-01099 (W.D. Ark.).
In a Nov. 1 motion to dismiss filed in the U.S. District Court for the Western District of Arkansas, Valspar Corp. claims that the plaintiffs fail to state facts upon which relief can be granted.
