ABERDEEN, Miss. -- A federal court has denied a defense motion to amend their notice of removal, finding that because the court had previously determined that it did not have jurisdiction over the claims, the motion is moot. Simmons, et al. v. First Chemical Corp., et al., No. 05-0002 (N.D. Miss.).

The U.S. District Court for the Northern District of Mississippi issued an order denying the motion on Oct. 11.

In a Sept. 21 order, the same court found that federal jurisdiction was not proper because the benzene plaintiffs had filed the instant lawsuit after their bankruptcy plan was confirmed, …
