Beech-Nut Baby Food Heavy Metals Case Dismissed for Lack of Standing

NEW YORK – A New York federal judge has dismissed a baby food heavy metals action against Beech-Nut Nutrition Co. after it had been reinstated by the 2nd Circuit U.S. Court of Appeals, ruling that the plaintiffs failed to show an economic injury-in-fact and therefore lack Article III standing.

In a March 19 order, Judge David N. Hurd of the U.S. District Court for the Northern District of New York found that plaintiffs did not identify specific misrepresentations made by Beech-Nut that induced their purchase of the baby food, as required to allege economic harm under the benefit-of-the-bargain theory.
