Plaintiffs Support Claim for Punitive Damages in Benzene Case

LOS ANGELES -- Plaintiffs who have asserted a claim for punitive damages in their benzene lawsuit have filed an opposition to a defense motion to strike that claim, arguing that the defendant has ignored the 'ultimate facts' of the lawsuit. Loyola, et al. v. Union Oil Co. of California, et al., No. BC280498 (Calif. Super. Ct., Los Angeles Cty.).

The July 20 opposition, filed in the California Superior Court for Los Angeles County, also claims that Neville Chemical Co. wrongfully requires the plaintiff to prove their fraud claim in their motion to strike certain portions of the benzene lawsuit.
