CHARLESTON, W.Va. -- The parties in a recently filed benzene lawsuit have agreed to the dismissal of defendant Flexsys America Co., stating that it does not presently appear that the chemical to which the plaintiff alleges exposure was on the defendant's premises during the alleged exposure time period. Hoffman, et al. v. Monsanto Co., et al., No. 05-0418 (S.D. W.Va.).
The June 13 dismissal in the U.S. District Court for the Southern District of West Virginia was entered without prejudice.
