Calif. Judge Denies J&J’s Motion to Dismiss Benzene Sunscreen AML Case

LOS ANGELES –– A California federal court has denied Johnson & Johnson’s efforts to dismiss a sunscreen benzene exposure case, finding that the plaintiff had “alleged sufficient facts” at this juncture of the litigation.

In the Dec. 12 order, the U.S. District Court for the Central District of California opined that the opposition asserted by the defendant was “best resolved at later stages of these proceedings.”

Johnson & Johnson Consumer Inc. filed the motion to dismiss, saying that the lawsuit filed by Kristi Hazard, as parent and legal guardian of P.H., a minor, was insufficiently pled.
