Benzene Plaintiffs Adequately Pled Claims Against Valspar, Del. Court Says

WILMINGTON, Del. –– A Delaware trial court has denied a motion to dismiss made by Valspar Corp. in a benzene case, finding that the plaintiffs’ complaint satisfied particularity requirements. Rose, et al. v. 3M Company, et al., No. N11C-08-102 BEN (Del. Super. Ct., New Castle Cty.).
In the July 19 opinion, the Delaware Superior Court for New Castle County found that the plaintiffs’ details regarding the defendant’s product and work sites where the alleged exposure took place were enough to support the claims against the company.
