La. Court Refuses to Reconsider Earlier Order Maintaining Jurisdiction Over Benzene Claims

NEW ORLEANS –– A Louisiana federal court has refused to reconsider an earlier order in which it retained jurisdiction over a benzene personal injury exposure lawsuit, concluding that the plaintiffs had failed to present any new legal or evidentiary arguments that would warrant disturbing the prior decision.

In the March 5 order, the U.S. District Court for the Eastern District of Louisiana also dismissed certain causes of action asserted against two defendants finding, in part, that the plaintiff could not assert claims outside of the Louisiana Products Liability Act against one of the parties.
