Del. Court Weighs in on Admissibility of Experts in Roundup Cases, Says Monsanto Not Entitled to Summary Judgment

WILMINGTON, Del. –– A Delaware state court has weighed in on the admissibility of experts in Roundup personal injury exposure lawsuits, finding that while the testimony of two plaintiff experts was inadmissible, Monsanto was still not entitled to summary judgment.
In the May 31 order, the Delaware Superior Court also rejected the plaintiffs’ motion to strike testimony proffered on behalf of Monsanto, concluding, in part, that the experts utilized reliable methods when finding that the glyphosate-based herbicide could not cause non-Hodgkin’s lymphoma.
